1. Service Description

The Media Hosting Service is a free service provided exclusively for users of VDO.Ninja, Social Stream Ninja, and Versus.cam. This service is offered as-is, without any guarantees, warranties, or service level agreements. The service is experimental and may be modified, suspended, or terminated at any time without notice.

2. NO WARRANTIES - DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

3. Acceptable Use & Your Responsibilities

• You are solely responsible for all content you upload
• You must own or have all necessary rights to upload content
• You are responsible for any copyright infringement or legal violations
• Prohibited content includes but is not limited to: illegal content, malware, spam, adult content, violence, harassment, or any content we deem inappropriate
• Maximum limits: 25MB per file, 1GB total (subject to change without notice)
• You must maintain backups of all your content - we are not a backup service
• You are responsible for any damages resulting from your use of the service

4. LIMITATION OF LIABILITY

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED $1.00 USD.

5. Indemnification

You agree to indemnify, defend, and hold harmless the service provider, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the service or violation of these terms.

6. Content Rights & Removal

• We may delete any content at any time for any reason without notice
• We have no obligation to store, maintain, or backup your content
• Content may be automatically deleted based on various factors including but not limited to: age, access patterns, storage limits, or system requirements
• We may access your content for service operation, legal compliance, or security purposes
• You grant us an irrevocable, worldwide license to use your content as necessary to provide the service

7. Security & Privacy Disclaimer

• We make no guarantees about the security of your data
• You use this service at your own risk
• We are not responsible for unauthorized access to your content
• We may share your information if required by law or to protect our interests
• Third-party authentication providers (Google, Discord, Twitch) have their own terms and privacy policies

8. Service Changes & Termination

• We may modify, suspend, or terminate the service at any time without notice
• We may change these terms at any time; continued use constitutes acceptance
• We may terminate your access for any reason without notice
• Upon termination, we have no obligation to maintain or return your content

9. Governing Law & Disputes

These terms are governed by the laws of the jurisdiction where the service provider is located. Any disputes must be resolved through binding arbitration on an individual basis. You waive any right to class action lawsuits or jury trials.

10. Final Terms

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision is not a waiver. These terms constitute the entire agreement between you and us regarding the service.
